Terms of Service
1. The service
dar-ion is an AI-powered web application that may provide conversational AI, web-enabled research, file analysis, project context, and related tools. Features, models, limits, and availability may change as the service evolves.
2. Eligibility and accounts
You must be legally able to enter into a binding agreement in your jurisdiction to purchase a paid plan. You are responsible for the accuracy of information associated with your account and for protecting your login credentials. You may not share an account in a way that bypasses plan limits or security controls.
3. AI outputs and important decisions
AI-generated output can be incomplete, inaccurate, outdated, or unsuitable for your circumstances. You are responsible for reviewing outputs before relying on them. dar-ion is not a substitute for qualified professional advice in areas such as medicine, law, finance, safety, or other high-stakes decisions.
4. Your content
You retain your rights in content you submit to dar-ion. You give dar-ion permission to host, transmit, process, reproduce, and otherwise use that content only as reasonably necessary to provide, secure, support, and improve the service. You represent that you have the rights and permissions needed to submit the content you provide.
5. Acceptable use
You may not use dar-ion to violate law, infringe others' rights, distribute malicious software, interfere with service operation, attempt unauthorized access, abuse or evade usage limits, scrape or overload the service, impersonate others, or use the service in a way that creates unreasonable security or operational risk.
6. Subscriptions and billing
Paid plans are billed through Stripe at the price and frequency shown at checkout, plus applicable taxes. Subscriptions automatically renew until canceled. Plan features and usage limits are shown in the product and may differ by subscription tier.
You can manage, upgrade, downgrade, or cancel an eligible subscription through the Stripe billing portal. Unless a different date is shown during the transaction, cancellation generally takes effect at the end of the current paid billing period and access continues until then.
Plan changes may produce prorated charges or account credits, as shown by Stripe before you confirm the change. A downgrade may create a Stripe account balance credit that is applied to future invoices rather than a cash refund. Except where required by law or expressly stated otherwise, subscription charges and unused portions of a billing period are nonrefundable.
7. Usage limits and service availability
dar-ion may enforce message, web, file-analysis, smart-model, guest, account, site-wide, or other usage limits. Limits may reset on a daily or billing-cycle basis as shown in the product. We may temporarily restrict access to protect the service, control abuse, manage costs, perform maintenance, or address security issues.
8. Third-party services
dar-ion uses third-party services, which may include OpenAI, Supabase, Netlify, Stripe, and web information sources. Your use of features that depend on those services may also be affected by their availability, policies, and technical limitations. dar-ion is not responsible for third-party websites or content you choose to visit.
9. Intellectual property
dar-ion, its branding, software, interface, and service materials are owned by dar-ion or its licensors and are protected by applicable intellectual-property laws. These Terms do not give you ownership of the service or permission to copy, resell, reverse engineer, or commercially exploit it except as allowed by law or by a separate written agreement.
10. Suspension and termination
We may suspend or terminate access when reasonably necessary for security, fraud prevention, nonpayment, unlawful use, material violation of these Terms, or protection of the service and its users. You may stop using dar-ion at any time and may cancel paid renewal through the billing portal.
11. Disclaimers
To the maximum extent permitted by law, dar-ion is provided "as is" and "as available" without warranties of uninterrupted availability, error-free operation, accuracy of AI output, or fitness for a particular purpose. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, dar-ion and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business opportunity, or goodwill arising from your use of the service. To the extent liability cannot be excluded, aggregate liability will not exceed the greater of the amount you paid to dar-ion during the three months before the event giving rise to the claim or US $100. Applicable law may provide additional rights.
13. Changes to the service or Terms
We may update the service and these Terms from time to time. Updated Terms will be posted on this page with a new revision date. If a change is material, we may provide additional notice when appropriate. Continuing to use dar-ion after updated Terms become effective means you accept them.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States federal law, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
